Personal data is processed by NovelloMac (hereinafter the "Data Controller"), duly registered in the Company Register at the competent Chamber of Commerce, in accordance with its corporate purpose relating to the marketing of new and used industrial machinery.

The Data Controller's contact details are provided in the "Contacts" section of the website.

2. TYPES OF DATA COLLECTED

The Data Controller collects the following categories of data:

2.1 Data provided voluntarily by the user

  • Name, surname, email, telephone number, company, and other data entered in messages.

  • Data sent via contact form, email, or WhatsApp.

2.2 Technical navigation data and cookies

  • IP address, browser type, anonymized technical data.

  • Technical, analytical, and profiling cookies (where applicable and subject to consent).

2.3 Data relating to commercial negotiations

  • Machine Preferences

  • Commercial documents and communications

  • Estimates, orders, contracts

3. PURPOSE OF THE PROCESSING

The data collected is used to:

  1. Respond to requests for information.

  2. Manage commercial negotiations on new or used machinery.

  3. Provide technical and commercial assistance.

  4. Comply with contractual, legal, tax, and administrative obligations.

  5. Safeguard the security of the site and data.

  6. Send commercial communications with prior consent.

4. LEGAL BASIS FOR PROCESSING (ART. 6 GDPR)

  • Consent of the interested party (art. 6.1.a): contact via website, email, or WhatsApp.

  • Pre-contractual and contractual measures (art. 6.1.b).

  • Legal obligations (art. 6.1.c).

  • Legitimate interest of the Data Controller (art. 6.1.f): security, prevention of abuse.

6. PUBLICATION OF MACHINERY

The site shows:

  • machinery owned by NovelloMac;

  • third-party machinery displayed with the owner's consent.

7. COMMUNICATION OF DATA TO THIRD PARTIES

The data will not be transferred to third parties , except:

  • legal obligations;

  • banks, leasing companies, freight forwarders or consultants necessary for the transaction;

  • contractually appointed and bound by confidentiality.

8. DATA STORAGE AND PROTECTION

  • Commercial and tax data: 10 years .

  • Technical data: according to technical log times.

  • Adopt appropriate technical and organizational measures (Article 32 GDPR).

9. USER RIGHTS (ARTICLES 15–22 GDPR)

The user can request:

  • limitation;

  • portability;

  • withdrawal of consent;

  • opposition to treatment.

11. CHAMBER OF COMMERCE REGULATIONS (CCIAA)

NovelloMac complies with the obligations set by the Chamber of Commerce:

11.1 Mandatory company information

  • Name

  • Registered office

  • VAT Number / Tax Code

  • REA

  • Company Register (Chamber of Commerce)

  • Corporate purpose: trade in new and used machinery

12. USED MACHINERY REGULATIONS

12.1 Conformity of used machinery

Depending on the case, the machine can be sold as:

  • compliant with the standards of the time of construction, or

  • not compliant with current standards (historic machinery).

12.2 CE marking for used products

If not delivered by the previous owner, always ask the manufacturer.

Not required if:

  • the machine has NOT been substantially modified.

12.3 Buyer's Responsibility

The customer is responsible for compliance according to:

  • Legislative Decree 81/08 (safety at work)

  • risk assessment

  • qualified installation and maintenance

13. NEW MACHINERY REGULATIONS

13.1 Seller's obligations

Every new car must have:

  • CE marking

  • CE Declaration of Conformity

  • User manual in Italian

  • Compliant identification plate

13.2 Pre-delivery checks

NovelloMac verifies:

  • manufacturer's documentation

  • compliance of protections

  • specifications agreed with the customer

13.3 Customer obligations

Use in accordance with:

  • Legislative Decree 81/08

  • user manual

  • internal safety regulations

14. MACHINERY TRACEABILITY (CHABER HOUSE)

NovelloMac preserves:

  • serial number, brand, model

  • origin

  • contracts, invoices, delivery notes

  • technical reports or certifications

Conservation:

  • 10 years (tax obligations)

  • 5 years (traceability recommended by the Chamber of Commerce)

15. WOOD MACHINERY SECTOR

15.1 Risks and installation

Machinery such as:

  • circular saws

  • toupie

  • multi-blade

  • edge banding machines

  • CNC

require:

  • installation in suitable environments

  • suction compliant with current regulations

  • specific training of operators

15.2 Machinery prior to the Machinery Directive (pre-1996)

They are sold on an “as is” basis – historic/non-CE machinery .

16. TERMS OF SALE

16.1 Private sale and applicable rules

The sale and purchase of machinery takes place according to:

  • Italian commercial legislation

  • EU legislation

  • banking, leasing and industrial credit practices

16.2 “SEEN AND LIKED” formula

Unless otherwise agreed in writing:

  • the machines are sold “ as is

  • no right to returns, recalls or refunds

  • The NovelloMac contract is fully effective after signing

16.3 Warranty

Except as otherwise stated in the contract:

  • Used machines are sold without warranty

  • any guarantees must appear in the official contract

16.4 International Sales

The customer is responsible for:

  • transport, customs, taxes

  • compatibility with local regulations

  • installation according to the law of the destination country

17. LIMITATION OF LIABILITY

NovelloMac is not responsible for:

  • improper use of the machinery

  • failure to make workplace adjustments

  • non-compliant installations

  • damage or injury resulting from incorrect use

  • damage or injury resulting from incorrect transportation, truck driving or positioning with cranes, walls or other equipment for moving/transporting the machinery

18. ACCEPTANCE

By signing the contract, the customer fully accepts:

  • Privacy Policy

  • Cookie Policy

  • Terms of Sale

  • Chamber of Commerce Regulations

  • Regulations for new and used machinery
